The South Dakota State House voted 40-30 to advance SB 201 – the so-called carbon capture pipeline compromise bill.

The measure would make substantial changes to the way the Public Utilities Commission permits future pipelines.

It calls for the PUC to be able override more burdensome county-level restrictions, including setbacks. The bill also states federal regulations trump county ordinances. An amendment to the bill, allowing counties to collect a one-dollar surcharge for every foot of pipeline running through their jurisdictions helped get SB 201 through.

Republican leaders says the bill protects landowners and counties while making carbon capture pipeline projects possible.

The House and Senate versions of the bill differ and it will go to conference committee, which will be appointed today.
